General Terms and Conditions of the Website

1. Definition of Terms

The owner and administrator of the website is Šraml d.o.o., Podnanos 66b, 5272 Podnanos, Slovenia.
The website constitutes all pages that are part of the web address (hereinafter referred to as “Website”).
The user of the website is any person who visits or uses any of the web pages on the website (hereinafter referred to as “User”). The website is accessible to an indefinite number of Users who, by using the website, accept the use of the Website and its Content under and in accordance with the present General Terms and Conditions.

2. Accepting the General Terms and Conditions

The present General Terms and Conditions describe, define and regulate the Content and Service use of the Website. As the administrator of the website, Šraml d.o.o. reserves the right to amend and update the General Terms and Conditions in accordance with applicable technical aspects and current legislation without giving prior notification to the users. By using the website, the User accepts these General Terms and Conditions and states that they are aware of them and agree to them.

3. Administrator Rights

All rights of all the web pages are reserved. All the information and materials, both in writing and in image form, on the web pages are, within the legally permitted scope, subject to copyright or other forms of intellectual property protection of Šraml d.o.o. and its associated partners, whose content is published on the web pages.
The User uses the content on the website on their own responsibility and solely for their personal use. All other forms of use of the content on the website are not permitted. The information and materials published on these web pages may not be copied, reproduced or otherwise disseminated for commercial purposes without the express written consent of Šraml d.o.o.
Šraml d.o.o. can change the legal notice at any time and it is binding for Users in every of its amended forms.

4. Business Terms and Conditions

We reserve the right to refuse the request for any service we offer on the Website, regardless of the reason. We also reserve the right to dismiss irrelevant messages we receive through the Website.

5. Privacy and Personal Data Protection

The premises where the Website server is located is appropriately physically secured. The User can address any questions in relation to the personal data protection on the website to
Šraml d.o.o. collects and processes certain personal data about their Website Users as well as certain data of the subscribers to the e-newsletter or those who either leave their contact information when completing the inquiry form or downloading the Website content. The personal data provided by the visitors to the Website will be used exclusively for the purposes specified in the present General Terms and Conditions. The administrator guarantees and undertakes to respect and protect the confidentiality of the personal data of their Website Users in accordance with current legislation. Šraml d.o.o. shall do everything in its power to protect Users’ personal data from any type of violation or misuse.
Šraml d.o.o. shall not forward personal data obtained by Users visiting the Website to third parties or unauthorized persons. Personal data can be forwarded to our sales representatives (third countries included) for the purpose of establishing contact and sharing our offers and services.
Šraml d.o.o. takes no responsibility for the accuracy of information provided by the Website’s Users. Should you fail to provide us with the personal information requested, we may be unable to process your inquiry. Upon completing the e-newsletter subscription, inquiry or file-download request form, the User must tick the box to confirm that they are familiar with and agree to the General Terms and Conditions. Should the User fail to tick the box to grant their consent to the General Terms and Conditions, Šraml d.o.o. reserves the right to refuse providing offers, promotions and other notifications to the User’s e-mail address, and guarantees not to collect or process the personal data provided by the User.

5.1 Contact Information Form

The Website’s User completes the Contact Information Form with their full name (name and surname(s)) and e-mail address (hereinafter referred to as “email”). This contact data is required for Šraml d.o.o. to be able to respond to Users’ questions and enquiries, share offers and promotions, provide information and contact them.

5.2 Inquiry Form

The Website’s User completes the Inquiry Form with their full name (name and surname(s)), company name, country and their email. This contact data is required for Šraml d.o.o. to be able to respond to Users’ questions and enquiries, provide quotes, offers and other information, and contact the Users of the Website. The Inquiry Form allows the User to subscribe to Šraml d.o.o. e-newsletter (for further reference, see Item 5.3).

5.3 E-Newsletter Subscription Form

By subscribing to the e-newsletter, the User provides Šraml d.o.o. with their e-mail address. Šraml d.o.o. collects only the e-mail address that the User provides in the subscription form and shall process it solely for the purpose of providing information about new products and offers, sharing promotional activities, success stories, attendance at trade fairs and other events, and other information regarding their business, in addition to statistical purposes.
The Users’ e-mail addresses shall be stored in the chosen mailing provider’s database for the purpose of notifications and shall not be used for any other purpose. Šraml d.o.o. may, in compliance with the EU and Slovenian applicable law on e-mail processing, provide e-mail addresses to third parties that have been performing individual processing tasks such as e-newsletter releases on behalf of Šraml d.o.o.
Similarly, the Website collects data on whether the e-newsletter is read by the Users, and what web pages are visited by clicking on the designated link to our Website in the received e-mail. Such data provide the necessary feedback for us to improve the quality of our e-newsletter while allowing us to contact the Users who show interest in our services or new products. The performance analysis of our e-newsletters is carried out pursuant to Article 6(1)(f) of the General Data Protection Regulation, allowing us to pursue our legitimate interests, i.e. offer individualized and convincing marketing offers of our products and services to persons who, by reading our newsletters, clearly show an interest in our services.
Each User has the right to request in written form at any time to unsubscribe from receiving newsletters to their email address, or they can unsubscribe by clicking on the “Unsubscribe” link provided in each e-newsletter. The User’s e-mail address shall be deleted from our mailing list within 90 days from the date of receiving the unsubscribe request.

5.4 Content Distribution

Upon downloading the Website content (Case Studies, User Manuals, Catalogues and other Website material), Šraml d.o.o. obtains the User’s full name (name and surname(s)), their e-mail address and company name.

5.5 Cookies

The web pages of use cookies. Cookies are small text files that are downloaded from the Websites the User visits and stored on their computer or mobile device. The website uses some cookies that are necessary for the Website to function and some that are used to improve the user experience (e.g. storing User preferences), and some that are used for statistical purposes, and to monitor visits to the Website, which helps the administrator improve the Website and the user’s experience.
When browsing, the user remains anonymous; the administrator does not collect the user’s personal data. For statistical purposes, Šraml d.o.o. reserves the right to only collect general, non-personal data that exclude individual personal characteristics. Using the Google Analytics tool, the Website collects information on what pages are visited, how often, the average website visit time and suchlike to see how many visitors visit our Website, what sections and pages they are most interested in, and whether they have encountered any problems during the visit, while, should they express a strong interest in the Website, we may try to target them with our ads (i.e. remarketing). This information is used by the administrator to measure the number of visits to the website and to improve content and functionality. User data is not subject to further processing and is not submitted to third parties.
Users of the Website can accept or decline cookies at any time. If a User does not want to accept cookies, they must change the settings of their browser so that all cookies are deleted from their computer’s hard drive, or block them or choose to receive a warning before a cookie is stored on their hard drive. We cannot in such cases guarantee that the User will be able to experience the full functionality of the website.
Remarketing frequent visitors of the Website is carried out pursuant to Article 6(1)(f) of the General Data Protection Regulation. In doing so, we pursue our legitimate interests, namely, to offer individualized and convincing marketing offers of our products and services to persons who, by visiting our websites, clearly show an interest in our services.
We immediately anonymize the data of the Website’s visitors and retain the data only in aggregate form, except for the remarketing data which is stored by Google until you request that it ceases to collect them at the website.
We do not share all of the above information with external Users. However, as far as analytics and remarketing is concerned, we process them with the assistance of Google (Google Analytics and AdWords), which in some cases may involve the transfer of personal information to the administrator in the USA. Such a transfer is permissible based on a specific decision by the European Commission called the Privacy Shield, which found that US companies that undertake to respect the principles of the Privacy Shield provide an adequate level of protection of personal data. 5.6 Social Networks

Šraml d.o.o. shares information and content through various communication channels such as the Šraml Facebook Page, Šraml Instagram Profile, Šraml TV YouTube Channel and Šraml LinkedIn account. Any post on the afore-mentioned social media is a reflection of the author’s personal review and opinion, and does not represent the opinions of Šraml d.o.o. We reserve the right to remove or change, without explanation and at our discretion, any post published on the Šraml brand’s social media pages that violates in any way the rights of others or is in any way illegal, offensive, shaming, vulgar or constitutes objectionable content.
Šraml d.o.o is not responsible for the personal opinions, reviews or inappropriate content present on social networks such as Facebook, Instagram, Twitter, and YouTube.

5.7 Participation in Prize Draws

The processing of data collected by participating in prize draws is governed by the rules on prize draws.

6. Exclusion of Liability

6.1  Use of Content

All information and materials on the website serve the purpose of informing. Šraml d.o.o. will endeavour to provide the most accurate and up-to-date information on its website; however, it does not assume any liability for their accuracy nor shall be held liable for any potential damage that may arise from it. Šraml d.o.o. retains the right to make changes to the content of the website at any time, in any way and regardless of the reasons, without prior notification, and does not assume any liability for any consequences of such changes.

6.2 Website Accessibility

All Users of all the published content uses it at their own risk. Therefore, neither Šraml d.o.o. nor any other legal or natural person who has participated or is participating in the operating and creation of the website is not liable for any damage that may be incurred by accessing the content, using or the failure to use the information on this website or for any other errors or flaws in their content. We reserve the right to restrict the access to the Website for the purpose of maintenance and equipment replacement. In the event of network outages or any outages, failures, other technical malfunctions or interruptions, we cannot guarantee the Website accessibility. Šraml d.o.o. shall not be held liable for any potential damage (including damage caused by computer viruses) to computer equipment, mobile phones or any other applications that enable access to the website incurred by the User visiting the website or using it in any way.

Our Sites may contain links to third-party applications or websites, i.e. External Websites. When you access an External Website, Šraml d.o.o. has no control over its content, applications, or services. We do not make any representations regarding the accuracy, quality, or accessibility of any External Website or its content or materials. Šraml d.o.o. disclaims all liability for any errors, omissions, violation of third-party rights or illegal conduct arising from such External Websites.

7. User Rights, Duration of Data Storage, etc.

Upon the request of a User, the administrator can notify them whether any of their personal data has been stored, and which. If the legal conditions are fulfilled, the User is entitled to amend, limit or delete this data. Automatically collected data, described in Item 5, is processed and stored until it is no longer used for its purpose. To conclude, we ensure that Šraml d.o.o. manages your personal information responsibly and in accordance with the established market practices.
